You are within your rights to push the aircraft for compensation directly under the Montreal Convention, if an airline accepts any item as checked baggage must accept responsibility. Most travel policies do not cover loss of baggage, but if they do, they will undoubtedly claim the money directly to the airline anyway.

The long and short of losing luggage is there is really no hard or fast or even guaranteed way to recover your luggage back. Only the means to try. Armed with this information you stand more chance of getting your luggage back or at least a little money to help relieve pain.
